Terms of Service

Last updated: 19 October 2026

These Terms govern your use of the Sahayakbuildcon real estate CRM: the website, the web and mobile apps, and the public property and project pages created with it (the "Services"). They form a binding electronic contract between you and us under the Indian Contract Act, 1872 and the Information Technology Act, 2000. Please read them carefully.

1. Acceptance of Terms

By creating an account, joining a workspace as a team member, or otherwise using the Services, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under Section 11 of the Indian Contract Act, 1872. If you use the Services on behalf of a business, you confirm that you are authorised to bind that business to these Terms.

3. The Services

Sahayakbuildcon is a CRM for real estate agents, brokers, builders, and their teams. It lets you:

  • capture buyer leads from your public property and project pages, WhatsApp, Meta Lead Ads, Google Ads lead forms, and manual entry;
  • manage leads through stages such as New, Contacted, Qualified, Site visit, and Negotiation, with notes, call outcomes, and follow-up reminders;
  • see each buyer as one customer across all their enquiries;
  • add properties and projects with units, amenities, photos, videos, brochures, and location, and publish them as public pages with a banner card and SEO details;
  • add team members and assign leads to them by project or locality;
  • connect your WhatsApp Business number to send brochures, property suggestions, and messages to your customers;
  • receive push notifications and use tools such as the property calculator.

Some features may be marked "beta", "preview", or "coming soon" and may change or be removed without notice.

4. Accounts, team members, and security

  • You must provide accurate and current information when you register.
  • You are responsible for keeping your OTPs and devices secure.
  • You are responsible for all activity under your account, including the actions of team members you add to your workspace. Remove a team member's access when they should no longer have it.

5. Listings and public pages

You are solely responsible for the properties, projects, and public pages you publish through the Services, including prices, unit details, photos, brochures, offers shown on banner cards, ratings and review counts, and SEO text. In particular, you agree that:

  • listing information is accurate, kept up to date, and not misleading;
  • you show a valid RERA registration number wherever the Real Estate (Regulation and Development) Act, 2016 and the rules of your state require it;
  • you have the right to use every photo, video, logo, and document you upload;
  • the Privacy Policy and Terms you add to your public project pages correctly describe how you handle the enquiries you receive.

We may remove or disable any listing or public page that appears unlawful, misleading, or in breach of these Terms.

6. Acceptable use

You agree not to:

  • use the Services for any unlawful, fraudulent, or harmful purpose;
  • upload viruses, malware, or other harmful code;
  • send unsolicited commercial messages in violation of the Telecom Commercial Communications Customer Preference Regulations, 2018 or the WhatsApp Business Messaging Policy;
  • scrape, reverse-engineer, decompile, or otherwise misuse the Services or their underlying code;
  • attempt to gain unauthorised access to any part of the Services or to other users' workspaces;
  • upload content that infringes any third party's intellectual property or privacy rights;
  • publish content that is unlawful under Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, including content that is defamatory, obscene, harassing, or harmful to minors.

7. Leads and personal data you handle

You are the Data Fiduciary for the personal data of the buyers, customers, and other contacts you record in the CRM or receive through your public pages, WhatsApp, and connected ad accounts. You are responsible for having a lawful basis, including any consent required under the Digital Personal Data Protection Act, 2023, to collect that data and to contact those people. We process it on your behalf as described in our Privacy Policy.

8. Intellectual property

The Services, including all software, design, logos, text, graphics, and trademarks, are owned by Sahayakbuildcon or our licensors and are protected by the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your own business while you use the Services.

9. Your content

You retain ownership of the data, listings, files, and messages you upload or create using the Services ("Your Content"). You grant us a limited licence to host, store, display, transmit, and process Your Content only as needed to provide the Services, including showing your public pages to visitors. You are solely responsible for the legality and accuracy of Your Content.

10. Third-party services

The Services rely on third-party platforms, including the WhatsApp Business Platform, Meta Lead Ads, Google Ads, Google Maps, Supabase, and Google and Apple push notification services. Your use of these is also subject to their own terms. We are not responsible for outages or changes to third-party platforms that affect the Services.

11. WhatsApp Business Platform: your obligations

When you connect your WhatsApp Business number to the Services, you become an end-user of Meta's WhatsApp Business Platform. By doing so you agree to, and are solely responsible for complying with:

In particular, you agree that you will:

  • send messages, including messages to several customers at once, only to people who have opted in to hear from you or with whom you have an existing business relationship;
  • not send spam or messages that violate WhatsApp's messaging policies;
  • not use your connected number for any purpose that Meta or WhatsApp prohibits, including misleading, illegal, or harmful content;
  • ensure that message templates you submit to Meta for approval are accurate and follow Meta's template guidelines;

We may suspend your WhatsApp integration without notice if we believe you are in breach of Meta's policies or these Terms, or if Meta restricts our access to your account. We are not liable for any suspension or restriction that Meta places on your WhatsApp Business Account.

12. Disclaimer of warranties

The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, that every lead will be delivered, or that leads will result in any sale. Figures from the property calculator and similar tools are estimates only and are not financial or legal advice.

13. Limitation of liability

To the maximum extent permitted by law, Sahayakbuildcon's aggregate liability arising out of or in connection with the Services, whether in contract, tort (including negligence), or otherwise, will not exceed ₹10,000. We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business, goodwill, or data. Nothing in these Terms limits any liability that cannot be limited under applicable law (for example, liability for gross negligence or fraud).

14. Indemnification

You agree to indemnify and hold harmless Sahayakbuildcon, its officers, employees, and affiliates from any claim, loss, liability, or expense (including reasonable legal costs) arising out of your breach of these Terms, your listings or public pages, your messages to leads and customers, your misuse of the Services, or your violation of any law or the rights of a third party.

15. Suspension and termination

We may suspend or terminate your access to the Services at any time for a breach of these Terms or for activity that we believe poses a security, legal, or reputational risk. You may stop using the Services and ask us to close your account at any time. Sections intended to survive termination (for example, intellectual property, limitation of liability, indemnification, and governing law) will remain in effect.

16. Governing law and dispute resolution

These Terms are governed by the laws of India. The parties will first try to resolve any dispute amicably. If a dispute remains unresolved for 30 days, it will be referred to arbitration under the Arbitration and Conciliation Act, 1996. The arbitration will be conducted by a sole arbitrator mutually appointed by the parties, in English, with its seat and venue at Mohali, Punjab. Subject to arbitration, the courts at Mohali, Punjab will have exclusive jurisdiction.

17. Changes to these Terms

We may change these Terms from time to time. The updated Terms will be posted on this page with a new "Last updated" date. Material changes will be communicated to you by email or in-app notice at least 7 days before they take effect. Continued use of the Services after the effective date means you accept the changes.
